Croton Man Receives 3rd DWI in White Plains

WHITE PLANS, N.Y. - Police responding to a phone call Sunday said they found a drunk Croton man fully-reclined behind the wheel of a 2000 Audi sedan parked half on the sidewalk and half on N. Broadway in White Plains. 

When officers approached the car around 7:30 p.m. Saturday, Marek Garbowsci, 38, of Croton, climbed out of his car and told officers, "That's my car. I am the driver," according to police reports. Officers said they noticed the smell of alcohol on Garbowsci's breath and that he had difficulty supporting himself as Garbowsci allegedly told police he drove "all over the place." 

Next to the fully-reclined drivers seat, officers said they found a cooler filled with five empty one-pint cans of Foster's beers. 

Police said Garbowsci opted not to take sobriety tests where he was found at 55 N. Broadway.

He was arrested and brought to police headquarters, where reports indicate, Garbowski refused three more sobriety tests. However, officers said he did admit to drinking in his car. 

Garbowsci was charged with one count of driving while intoxicated, a misdemeanor. According to police reports, Sunday night's crime was Bargowski's third arrest for drunk driving. In May 2005, Garbowsci was convicted of driving while drunk in Mount Vernon, and in June 2005, he was convicted of driving with a blood alcohol content level above the legal limit in Cortlandt.
